Hmmm....
I listened to the hearing and increasingly I came to the conclusion that the judges seemed to be looking for a fudge that would get them out of making a definitive decision on Proposition 8. They appeared to be heading for upholding the Yes on Prop 8 vote but still maintaining the legitimacy of the marriages that had taken place prior to the vote. This inconsistency would only lead to even more challenges in the future.
Mind you, this was the first time I've listened to a Supreme Court deliberation (the last time I read a Supreme Court ruling it was in the Bush/Gore election and that left me on-the-floor astonished at the complete absence of shame in a judiciary so obviously playing politics), so I could be missing something vital.
